LITIGATION

The Firm has an expanding practice representing boards in civil litigation in both state and federal court. Firm attorneys have successfully defended boards in:

Civil Rights matters;

Employment discrimination allegations;

Student matters from discipline appeals to special education issues;

Contract and financial issues;

Public records/Sunshine Law;

Employee benefit matters;

Challenges to Ohio’s Political Subdivision Tort Liability Act; and

Attempts to obtain injunctive relief.

Firm attorneys have experience in all aspects of litigation, from responding to initial pleadings, working through the discovery process, and, when necessary, in the courtroom (both trial and appellate). In addition to this practical litigation and trial experience, our lawyers regularly attend additional training at the National Institute for Trial Advocacy. Recently, the Firm added to its capability through the addition of an attorney seasoned in the defense of personal injury claims.

Since 1997 the Firm has been appointed by insurance carriers to defend over 70 school boards in more than 100 cases. In these cases boards were alleged to have violated the civil and/or constitutional rights of employees, prospective employees and students. Through this representation Firm attorneys have developed an in-depth knowledge of constitutional and civil rights law as it applies to Ohio school boards. The Firm has been accepted for inclusion in the 2003 Best’s Directory of Recommended Insurance Attorneys and Adjusters.
